Secure Flight Required Privacy Notice
Instructions:
- Prior to collecting information through a Web site or self-service kiosk from a passenger or non-traveling individual, a covered aircraft operator must make available the complete privacy notice set forth below.
- Based on industry feedback, Secure Flight has recently updated its privacy notice from the notice originally published in the Secure Flight Final Rule, Consolidated User Guide (CUG), and Privacy Impact Assessment (PIA). The updated notice more clearly communicates to passengers that failure to provide full Secure Flight Passenger Data may result in denial of transport or denial of authority to enter the boarding area.
- Per the Secure Flight Final Rule: The privacy notice must be available on public websites and self-serve kiosks before collecting any personally identifiable information from passengers or non-traveling individuals. (49 CFR 1560.103).
- Aircraft operators using a prior version of the privacy notice taken from the Secure Flight Final Rule or CUG may continue to use that notice. TSA intends to update regulatory documentation as appropriate to incorporate this information in the near future. This notice will also be posted to the TSA Web Board for your reference. Aircraft operators are authorized to use the updated privacy notice shown below to satisfy the requirements of 49 CFR 1560.103.
Privacy notice (found in Section 1560.103 of the Secure Flight Final Rule): The Transportation Security Administration (TSA) requires you to provide your full name, date of birth, and gender for the purpose of watch list screening, under the authority of 49 U.S.C. section 114, the Intelligence Reform and Terrorism Prevention Act of 2004 and 49 C.F.R parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth, and gender may result in denial of transport or denial of authority to enter the boarding area. TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice.
